Privacy Policy – California Applicant Privacy Notice

Introduction and Scope

This California Applicant Privacy Notice (“Notice“) is provided to California residents who apply for employment, consulting, contractor, or temporary placement opportunities with BCforward, Inc. (“BCforward,” “we,” or “us“) pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA“).

BCforward is the business responsible for collecting and processing the Personal Information described in this Notice. This Notice applies to all Applicants who are California residents and covers Personal Information collected through BCforward‘s recruiting, staffing, and placement activities, whether submitted online, in person, or through other channels.

In the event of a conflict between this Notice and the general Privacy Policy with respect to Applicant Personal Information, this Notice shall control.

• “Applicant” means a California resident who applies for employment, consulting, contractor, or temporary placement opportunities with BCforward.

BCforward collects Applicant Personal Information from the following sources:

• Directly from you, including through applications, resumes, interviews, and communications submitted in connection with employment, consulting, contractor, or temporary placement opportunities.
• Your professional references, as identified by you during the application process.
• Prior employers, with your authorization, for purposes of employment verification and reference checks.
• Publicly available professional profiles and databases (e.g., LinkedIn, professional licensing boards).
• Background check providers engaged to conduct criminal history checks, employment verification, and credential verification.
• Our clients, in connection with evaluating and facilitating placement opportunities.

Purposes of Collection and Use

BCforward collects and uses Applicant Personal Information for the following Business Purposes:

• Evaluating qualifications and suitability for employment, consulting, contractor, or temporary placement opportunities;
• Communicating with Applicants about opportunities, interviews, and application status;
• Conducting background checks and verifying credentials, with consent where required by law;
• Complying with legal obligations, including employment eligibility verification (I-9/E-Verify), EEO reporting, tax withholding, and workplace safety requirements;
• Administering onboarding, payroll, and benefits for placed candidates;
• Maintaining internal records for compliance, audit, and litigation purposes;
• Improving recruiting and placement processes.

Disclosure and Sharing of Personal Information

BCforward may disclose Applicant Personal Information to the following categories of third parties in connection with staffing, placement, and employment purposes:

• Clients and prospective clients for purposes of evaluating placement opportunities;
• Background check and drug screening providers;
• Payroll, benefits, and insurance administrators;
• Government agencies as required by law (e.g., E-Verify, EEOC, state workforce agencies);
• IT and technology service providers that support our recruiting systems;
• Legal counsel and auditors.

BCforward does not sell Applicant Personal Information. If BCforward shares Applicant Personal Information for cross-context behavioral advertising purposes (e.g., through tracking technologies on career pages), you may opt out by using the “Do Not Sell or Share My Personal Information” link on our website.

Retention of Personal Information

BCforward retains Applicant Personal Information for as long as reasonably necessary to fulfill the purposes described in this notice, to comply with applicable legal obligations, and to resolve disputes or enforce agreements.

Retention periods vary by data type and applicable legal requirements. As a general practice, Applicant records are retained for a minimum of three (3) years following the last interaction with the Applicant or the conclusion of a placement, whichever is later. Certain records may be retained for longer periods where required by federal, state, or local law, or where necessary for ongoing litigation, audit, or compliance purposes.

When Applicant Personal Information is no longer required for any of the foregoing purposes, BCforward will securely delete or de-identify such information in accordance with applicable law and internal data management policies.

Your Rights Under the CCPA

As a California resident, you have the following rights under the CCPA with respect to your Personal Information:

• Right to Know: You may request that BCforward disclose the categories and specific pieces of Personal Information it has collected, used, disclosed, or shared about you.

BCforward will verify your identity before processing your request. Verification may require you to provide information that matches records we maintain about you. If you designate an authorized agent to submit a request on your behalf, we may require proof of the agent’s authorization and separate verification of your identity.

BCforward will respond to your verifiable request within forty-five (45) days of receipt. If additional time is required, we will notify you of the extension and the reason for it, as permitted under the CCPA.

Changes to This Notice

BCforward reserves the right to update or modify this notice at any time to reflect changes in our practices, legal requirements, or regulatory guidance. When we revise this notice, we will update the “Last Updated” date at the top of this notice to reflect the date of the most recent revision.

Where changes are material, BCforward will provide notice through reasonable means, which may include posting the revised notice on our career pages, sending direct communication to affected Applicants, or other methods appropriate under the circumstances. Your continued submission of Personal Information to BCforward after any such update constitutes acknowledgment of the revised notice.
